Terms of Service

These terms are an agreement between HA Assure Group Pty Ltd (ABN to be inserted) ("we", "us") and the organisation that subscribes to Engineering HA Assure (the "Institution"). The person who accepts them confirms they are authorised to bind the Institution.

1. The service

Engineering HA Assure is software that helps engineering education providers organise program outcomes, map them to Engineers Australia competency standards, record student attainment and practice exposure, and prepare accreditation evidence. It is delivered online on a subscription basis.

2. Your account and users

The Institution controls who has access, assigns roles, and is responsible for everything done under its accounts. Staff, program leaders and auditors must use two-factor authentication. Keep passwords private and tell us at info@ha-assure.com straight away if you suspect misuse.

3. What we do not do

This clause sets the boundary of our responsibility. We do not:

• grant, guarantee or predict any accreditation outcome. Accreditation decisions are made solely by Engineers Australia;
• act for, represent, or hold any endorsement from Engineers Australia, the International Engineering Alliance, ASQA or TEQSA;
• check the accuracy of the curriculum, results, reflections or other content the Institution enters;
• provide legal, regulatory or financial advice through the software;
• reproduce Engineers Australia's copyrighted standards. The software stores competency codes and short labels; the Institution reads the full standards from Engineers Australia.

Any suggested mapping or crosswalk in the software is a starting point only. The Institution confirms its own mappings.

4. Your data

The Institution owns its data, including student records. We process it only to provide the service, under the Data Processing terms and the Privacy Policy, which form part of these terms. The Institution is responsible for having a lawful basis to enter student information and for telling its students how it is used.

5. Acceptable use

Do not attempt to access another institution's data, probe or disrupt the service, upload malicious files, or use the service unlawfully. We may suspend access to protect the service or other customers, and will tell you why.

6. Fees and payment

Fees are set out on the pricing page, charged annually in advance in Australian dollars, and are exclusive of GST unless stated. The annual fee is recalculated at renewal from the programs and active students in the workspace. New workspaces receive a 30-day free trial.

7. Trial end and non-payment

If the trial ends or a payment fails, the workspace becomes read-only. Nothing is deleted and data can still be viewed and exported.

8. Cancellation and refunds

Cancellation and refunds are governed by the Refunds and Cancellation policy, which forms part of these terms.

9. Availability and support

We aim for high availability but do not guarantee uninterrupted service. Support is by email at info@ha-assure.com. We maintain daily automated backups and point-in-time recovery.

10. Intellectual property

We own the software. The Institution owns its content. The Institution grants us a licence to host and process its content solely to provide the service.

11. Liability

Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, our total liability is limited to the fees paid by the Institution in the 12 months before the claim, and we are not liable for indirect or consequential loss.

12. Changes to these terms

We will give at least 30 days' notice of any material change. If you do not agree, you may cancel before the change takes effect and receive a pro-rata refund of prepaid fees for the unused period.

13. Governing law

These terms are governed by the laws of Western Australia.
